Terms of Service

Mellowish lets you organize gift exchanges (Secret Santa name draws), create and share wishlists, coordinate with groups, and — on the premium plan — track gifts and shipments. The Service may change or be discontinued at any time.

Everything most groups need is free: name draws with household rules, wishlists with claiming, invitations by email or link, and group and anonymous messages, for events with up to 25 people.

Premium adds events with more than 25 people and the gift and shipment tracker. Other premium features listed in the app as “planned” are not yet available.

Premium is not on sale yet. Until it is, nothing you can do on the free plan will be locked away mid-exchange. If we start charging, we will publish prices and billing terms before taking any payment, and these Terms will be updated.

• You need a valid email address to sign in (by magic link or with Google).
• You must be at least 16 years old.
• You are responsible for activity under your account. Keep your email inbox and any sign-in provider account secure, since anyone with access to them can sign in as you.

You agree not to:

• Use the Service for any unlawful purpose.
• Harass, defraud, or impersonate others.
• Invite people who have not agreed to hear from you, or use invitations to send unsolicited messages.
• Attempt to access others’ events, wishlists, matches, or data without permission.
• Interfere with or disrupt the Service, or scrape or extract data at scale.

You retain ownership of content you create (events, wishlists, messages, etc.). You grant us a limited license to store and display that content in order to operate the Service and to show it to the people you share it with.

Sharing is built into the Service. What other participants can see — names, wishlists, claims, messages — is described in the Privacy Policy. By adding content to an event, you accept that the other members of that event will see it as described there.

When you invite someone by email, we send them an invitation on your behalf to the address you enter. Only invite people you know and who would expect to hear from you. You are responsible for the addresses you enter.

By using the Service you agree to receive the emails it needs to operate: sign-in links and invitations. We do not send marketing email.

The Service is provided “as is” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee uninterrupted or error-free operation, or that data will never be lost.

To the maximum extent permitted by law, Mellowish and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of data or profits, arising out of your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the twelve months preceding the claim (which, while the Service is free, is zero).

You may stop using the Service at any time and delete your account from your profile page. We may suspend or terminate accounts that violate these Terms, and may remove content that does.

We may update these Terms from time to time. Continued use after changes are posted constitutes acceptance.

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles.
